Terms of service

You accept these terms when you create an account. The checkbox at sign-up records the date and version.

Pointspoken is operated and developed by Avenor Development Technologies Limited (“Pointspoken”, “we”, “us”). These terms are an agreement between you and Avenor Development Technologies Limited covering Pointspoken at pointspoken.com. By creating an account or using the service you agree to them. Please also read our privacy policy and refund policy, which form part of these terms.

1. What Pointspoken is

Pointspoken helps working professionals practise speaking English for workplace situations. You record a short spoken answer to a prompt, or hold a short live conversation with an AI playing a manager, interviewer or colleague, and the service returns a transcript and written feedback: one strength, up to three improvements that quote your own words, and a clearer version of your answer.

The feedback is produced by software, including large language models, and is offered for practice only. It is not a language assessment, an exam score, a professional or career guarantee, or medical, legal or therapeutic advice. It can be wrong, incomplete or unsuited to your situation, and you use it at your own judgement.

2. Who can use it

  • You must be at least 18 years old and able to enter a binding contract.
  • You need an email address you control. We send a sign-in code to it instead of using passwords, so keep access to that mailbox secure.
  • One account is for one person. Do not share your account or use someone else's.
  • If you use Pointspoken on behalf of an employer, you confirm you are allowed to do so and that these terms bind you personally as well.

3. Free plan, trial and subscriptions

Free plan

Every account includes 3 completed analyses and 1 roleplay at no charge. A completed analysis is one that returns feedback; attempts that fail in processing are not counted.

Trial

A paid plan starts with a 7-day free trial that includes up to 15 analyses and 2 roleplays. A payment method is required to start it. If you do not cancel before the trial ends, the plan you chose begins and is charged automatically. You can cancel at any time during the trial from Settings and you will not be charged.

Paid plans

  • The monthly plan costs $20 per month. The annual plan costs $144 per year, billed once. Both include 60 analyses per month and 5 roleplays per week. Unused allowances do not carry over.
  • Prices are shown before checkout and may exclude sales tax or VAT, which is added at checkout according to your location.
  • Subscriptions renew automatically at the end of each billing period until you cancel. Cancelling stops the next renewal; your access continues until the end of the period you have paid for.
  • If a renewal payment fails, paid features continue for 3 days while you update your payment method, then pause until a payment succeeds.
  • We may change prices or allowances. We will tell you by email at least 30 days before a change affects you, and it applies from your next billing period. If you do not agree, cancel before then.

Payments and merchant of record

Payments are handled by Paddle.com Market Limited (for customers outside the United States) or Paddle.com Inc. (for customers in the United States), which act as the merchant of record. Paddle sells the subscription to you, issues invoices and handles sales tax. Paddle's checkout terms apply to each transaction alongside these terms.

Refunds and cancellation rights

Our refund policy explains when a charge is refunded, including a 14-day window after a first charge or renewal. If you are a consumer in the European Union or the United Kingdom, you also have a statutory right to withdraw from a new subscription within 14 days; the refund policy is the simplest way to exercise it. Nothing in these terms removes rights that consumer law gives you and that cannot be excluded.

4. Your recordings, transcripts and feedback

  • You own your recordings, the transcripts of your speech and anything you say in a roleplay. You give us a non-exclusive, worldwide licence to store, process and transmit that content only as needed to provide, secure and improve the service for you.
  • Raw audio of a recorded answer is deleted within 24 hours of processing. Transcripts and feedback are kept in your history until you delete them or your account.
  • Roleplay audio streams live to the voice model and is not stored by us; only the text transcript is kept.
  • Do not record other people without their consent, and do not include confidential employer or customer information, personal data about others, or anything you are not permitted to share. You are responsible for what you submit.
  • We do not use your recordings or transcripts to train models. The AI providers we use are contractually bound not to train on your content either; see the privacy policy for the current list.
  • Suggested wording in feedback is one possible version of what you said. You may use it freely and we make no claim to it.

5. Acceptable use

You agree not to:

  • use the service for anything unlawful, or to harass, threaten or defame anyone;
  • submit content that is illegal, infringes someone else's rights, or contains malware;
  • try to make the AI ignore its instructions, extract other people's data, or produce harmful content;
  • access the service by automated means, resell it, or use it to build a competing product;
  • interfere with the service's security or attempt to bypass usage limits, trials or payment.

We may limit, suspend or close an account that breaks these rules. Where the breach is minor and you fix it promptly, we will normally warn you first.

6. Third-party services

Pointspoken relies on third parties to run: Google (Gemini models for transcription, feedback and live roleplay), Supabase (sign-in and database), DigitalOcean (hosting), Cloudflare (domain, network and file storage), Resend (email) and Paddle (payments). Their availability affects ours. The privacy policy lists what each receives.

7. Our intellectual property

The Pointspoken name, design, prompts, coaching rubric, software and documentation belong to Avenor Development Technologies Limited or its licensors. You may use the service for your own practice under these terms; you may not copy, modify, distribute or reverse engineer it, except where the law allows.

8. Availability and changes

We aim for the service to be available and for analyses to finish within a few minutes, but we do not guarantee uninterrupted access, processing times, or that transcription and feedback are accurate. We may change, add or remove features. If we withdraw a paid feature that materially reduces what you paid for, you may cancel and we will refund the unused part of your current period.

9. Ending the agreement

  • You can delete your account at any time from Settings. This cancels any subscription and deletes your content as described in the privacy policy.
  • We may close your account if you materially breach these terms, if the law requires it, or if we stop offering the service. In the last case we will give at least 30 days' notice and refund any prepaid period you cannot use.
  • Sections 4, 7, 10, 11 and 12 continue to apply after the agreement ends.

10. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. Feedback is automated and may contain errors. We do not promise that using Pointspoken will improve your English, your performance at work, or the outcome of any interview or meeting.

11. Limitation of liability

To the fullest extent permitted by law, Avenor Development Technologies Limited is not liable for indirect, incidental, special or consequential loss, including lost profits, lost opportunities or loss of data, arising from your use of the service. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or 50 US dollars if you have paid nothing.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing removes the statutory rights of consumers.

12. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, where Avenor Development Technologies Limited is based, without affecting any mandatory consumer protection you have under the laws of the country where you live. If you have a problem, email [email protected] first: we aim to resolve complaints within 14 days. Consumers in the European Union may also use the European Commission's online dispute resolution platform.

13. Changes to these terms

We may update these terms as the service changes. For material changes we will email you at least 14 days before they take effect. Continuing to use Pointspoken after that date means you accept the updated terms; if you do not, cancel your subscription and stop using the service before then.
